Abstract:

Many new products, including for example smartphones, tablets and laptops, rely on complementary technologies‎ which are often patented. Companies manufacturing and commercialising those complex products (the implementers) often complain about the cost of those patents. They argue that the royalty stack is too high and that forces them to set higher prices for their products to the ultimate detriment of consumers. They have proposed a number of policy initiatives aimed at moderating the cost of intellectual property (IP). These proposals, which seek to limit the bargaining power of patent holders, include reforms of the patent laws, of the IP policies of standard setting organisations, etc. In this lecture Dr. Padilla will present the arguments made by implementers and patent holders and discuss the merits and likely implications of some of the proposals currently under consideration in various jurisdictions around the world. This presentation will rely on a number of papers that Dr. Padilla has written on these issues as well as on his consulting experience in antitrust and arbitration disputes between implementers and patent holders
